IMPORTANT NOTICE: THESE TERMS INCLUDE A MANDATORY ARBITRATION PROVISION THAT REQUIRES THE USE OF ARBITRATION INSTEAD OF JURY TRIALS OR CLASS ACTIONS TO RESOLVE DISPUTES.

If you don't agree with these Terms or our Privacy Policy, please don't use our Services. We may update these Terms at any time, and continued use of our Services means you accept those changes.

1. Your License to Use Our Services

When you sign up for GHOST Marketing, we grant you a limited, non-exclusive, non-transferable license to use our surveillance technology and visitor identification platform. This license allows your authorized users to unmask anonymous website visitors and leverage the actionable intelligence our Services provide. All fees are quoted in US Dollars, and unless explicitly stated otherwise, ALL SALES ARE FINAL WITH NO REFUNDS.

Our software may include third-party components governed by their own licenses. By using our Services, you agree to comply with those third-party terms as well.

2. Account Requirements

By creating a GHOST Marketing account, you confirm that:

• You're at least 18 years old
• The information you provide is accurate and up-to-date
• You'll follow all applicable laws when using our Services
• You're responsible for maintaining the security of your account credentials

We may terminate accounts containing inaccurate or outdated information without prior notice.

3. Communications and Marketing

By using our Services, you agree that GHOST Marketing may:

• Contribute anonymized data to the GHOST Data Co-op
• Use, sell, or distribute anonymized data for product development, marketing, and broader insights

While we track data origins internally, we never disclose your identity to other Co-op members or reveal identifiable client information.

6. Payments and Purchases

We may use third-party payment processors. By submitting payment information, you confirm you have the legal authority to use that payment method. We reserve the right to refuse or cancel orders for any reason, including suspected fraud or errors in pricing.

7. Prohibited Activities

When using GHOST Marketing, you agree NOT to:

• Reverse engineer or decompile our software
• Misappropriate our code or intellectual property
• Process data unlawfully or without proper authorization
• Engage in harmful, offensive, or abusive activities
• Interfere with the proper operation of our Services
• Attempt unauthorized access to our systems
• Scrape or harvest information without permission

8. Accuracy and Availability

16. Copyright Infringement Claims

If we don't enforce a specific provision, it doesn't waive our right to do so later. If a court finds any part of these Terms unenforceable, the rest remain valid. These Terms represent our entire agreement regarding our Services and supersede any prior agreements.GHOST Marketing makes no representation that our Services are appropriate for use outside the United States or in all US territories.
